Funeralocity Data Privacy Policy

At Funeralocity, Inc. (hereinafter the “Company,” “us” or “we”), your privacy is important. This Data Privacy Policy (the “Policy”) discloses the privacy practices for our Company’s website (collectively, the “Site”), as well as related tools and content offerings we may offer to individual families (users of our site are referred to herein as a “Family” or “Families” and the tools and content offered to Families on our Site are collectively the “Services”).

This Policy discloses how we treat information that we receive or collect about you. This Policy is designed to be read in conjunction with our Consumer Terms, available at www.funeralocity.com, and that by accessing or using our Site or Services, you agree to be bound by the Site’s terms and conditions, as well as this Policy.

We reserve the right to change our Privacy Policy from time to time. Your use of the Site and/or Services constitutes your acknowledgment to be bound by the current Policy, and your agreement to be bound by any amendments we may make to the Policy from time to time. Amendments to the Policy may occur with or without notice to you. You agree to review the Policy from time to time. We shall have no liability for your failure to review any amendments to the Policy.

BY USING OUR SITE AND/OR SERVICES, YOU PROVIDE YOUR EXPRESS CONSENT THAT ALL PERSONAL DATA THAT YOU SUBMIT MAY BE USED, PROCESSED, OR DISTRIBUTED PURSUANT TO THE TERMS OF THIS POLICY AND OUR CONSUMER TERMS. YOUR USE OF OUR SITE AND SERVICES CONFIRMS YOUR ACCEPTANCE OF THIS POLICY.

I. Collected Information

In order to better provide you with dynamic pricing tools, funeral home information, consumer reviews, and a high-quality browsing experience, we collect two types of information about our users: Personally Identifiable Information (“PII”) and Summative Information.

  • a. Personally Identifiable Information:

    PII refers to information that provides us with information about who you are. PII may be used on its own or in the aggregate with other data to identify, locate, or contact an individual person. When ordering or registering on our site, you may be asked to enter your name, email address, phone number, decedent’s name, or other details to help you with your Site experience.

  • b. Summative Information:

    Summative Information refers to data that does not by itself identify a specific person. Our Site and Services gather certain information about you based upon what content you access on our Site and what other sites may have directed you to us. This information may be collected in a variety of different ways such as the Website’s Uniform Resource Locator (“URL”) that points to the site from which you arrived, links on our site which take you away from Funeralocity to other sites, browser information, and your Internet Protocol (“IP”) address.

II. Collection Methods

We do not collect any PII unless you provide it to the Site and Services voluntarily. Notwithstanding the foregoing, you will be required to provide certain PII to us when you elect to use certain Services, including but not limited to: (i) registering for an account on our Site; (ii) filling out or entering information into Funeral Provider forms which may appear on our Site; (iii) sending us email messages; (iv) transmitting information to us via other means, including letter, phone, fax, or scans; and (v) when responding to communications from us.

PII is used to enhance our Site and Services. PII may be used by us to resolve disputes, solve issues related to the Services, and enforce our Policy and Consumer Terms.

III. Cookies

We will store cookies on your computer which record limited details about your browsing session and transactions with the Site. If a browser is configured to refuse cookies, important parts of Funeralocity.com will not function properly.

Cookies may also include more personalized information, such as your IP address, browser type, the server your computer is logged onto, the area code and zip code associated with your server, and your first name to welcome you back to our Site. For instance, we may also use cookies to help us remember and process the funeral home information you have selected as well as to help us understand your preferences based on your Site activity. We may also use cookies to compile aggregate data about traffic on our Site. We may enlist the services of trusted third parties that track this information on our behalf. Cookies may also be used to monitor site data and analytics, remember passwords if so requested by Families, and store account settings that Families input on our Site and Services.

IV. Third Party Disclosures

We do not sell, trade, or otherwise transfer your PII to others unless we provide you with advance notice, as we do when we connect users of the Site to one or more funeral homes that they select. We may provide non-PII to third parties for any purpose.

As necessary our Services may be provided through contractual arrangements made with affiliates, service providers, partners and other third parties (“Site Partners”). We and our Site Partners may need to use some PII in order to perform tasks between our respective sites, or to deliver Services.

The use of your PII by our Site Partners is governed by the respective privacy policies of our individual Site Partners, and is not subject to our control. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Other Sites accessible through this Site, including our Advertising and Site Partners, have their own privacy policies and data collection, use and disclosure practices. We are not responsible for the policies or practices of third parties, and we expressly disclaim any liability for those practices or policies.

We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety. In such cases, we will disclose PII upon receipt of a court order, subpoena, or to otherwise cooperate with a law enforcement investigation. We reserve the right to report to state, federal, or local law enforcement agencies or departments any activities that we in good faith believe to be unlawful.

Our Site uses the following services: Google AdSense Advertising, Remarketing with Google AdSense, Google Display Network Impression Reporting, Demographics and Interests Reporting, DoubleClick Platform Integration, HotJar and Mix Panel. Google is a third-party vendor which uses cookies to serve ads on our Site. Google's use of the DART cookie enables it to serve ads to our users based on their visit to our Site and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy and following the instructions available therein at https://www.google.com/policies/technologies/ads/.

HotJar is a third-party vendor that the site leverages for Conversion Rate Optimization. The tool will measure site activity by visually representing clicks, taps and scrolling behavior on the site.

Mix Panel is a third-party vendor that tracks user interaction with the site and allows for targeted communication.

V. Collected Information

  • a. California Online Privacy Protection Act (CalOPPA)

    Our Site shall comply as necessary with CalOPPA provisions. California law requires us to provide you with information regarding how we respond to a web browser’s Do Not Track (“DNT”) signals. At present, there is no uniform legal or funeral industry standard for recognizing DNT signals. In order to continue to provide Families with a cost effective and functional Site experience, we do not respond to DNT signals at this time.

  • b. CAN-SPAM Act

    We agree that if at any time you would like to unsubscribe from receiving future emails, you can email us at unsubscribe@funeralocity.com and we will promptly remove you from all correspondence. Funeralocity cannot control the mailings or content sent to you by any of our Site Partners, but we will make good faith efforts to encourage compliance by our Site Partners. Further, electronic messages sent to you by us will not contain false or misleading headers, will have a clear subject line, and will otherwise comply with the CAN-SPAM Act.

  • c. COPPA (Children Online Privacy Protection Act)

    We comply with the Children's Online Privacy Protection Act (COPPA). We do not specifically market to children under 13. You must be at least 18 years old to have our permission to use this Site. We do not knowingly collect, use, or disclose PII about minor visitors.

VI. PII Security

We host your PII behind secured networks which are accessible by a finite number of persons who have special access rights to our networks and systems. We maintain a variety of security measures when a user enters their PII into our Site and Services. Where necessary, we use encryption via Secure Socket Layer (SSL) technology. We use malware and spyware scanning software to actively monitor our Site and Services on a regular basis for security concerns.

SECURITY DISCLAIMER: no data transmission over the Internet or any wireless network can be guaranteed to be fully secure. While we strive to protect your PII, you acknowledge that: (i) there are security and privacy limitations integral to the internet which we cannot control; (ii) the security, integrity and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed; and (iii) due to redundant back-up systems, it may be impossible to completely remove residual PII in the event we receive a deletion request from a Family.

VII. Miscellaneous

If you voluntarily disclose PII on our Services where review comments may be posted by Families, the information you post may be collected and used by third parties and may result in unsolicited messages and/or SPAM from third parties. We cannot control those third parties, and this Policy does not apply to such information.
